Please read the Truist Connected Banking Terms and Conditions (“Agreement”) carefully. By selecting “Connect” you indicate that you have read and agree to be bound by this Agreement.
This addendum to the Truist Online and Mobile Banking Service Agreement and the Truist Online and Mobile Banking for Business Service Agreement (collectively “Online Service Agreements”) contain the terms governing your use of the Truist Connected Banking Terms and Conditions. If we make changes to this addendum, we will update the addendum on the website. We will notify you of any changes or new features following the procedures specified in the Online Service Agreements. Your enrollment and use of Truist’s Connected Banking Service (“the Service”) constitutes your agreement to the addendum, as amended from time to time. In the event of any inconsistency between this addendum and the Online Service Agreements, this addendum will control.
As used in this Agreement the words “we,” “us,” and “our,” refer to Truist Bank or its affiliate. The term “Affiliate” means the parent company of Truist Bank, Truist Financial Corporation, and any present or future company that controls, is controlled by, or is under common control with Truist Bank. The words “you” and “your” refer to you as the consumer or business using the Service. The words “you” and “your” also include any user you authorize to use the Service on your behalf. “Company” means the third-party company that you are connecting your Truist accounts to, as permitted by law.
GENERAL TERMS
The Service is not guaranteed and may not be available at all times. We may modify this Agreement at any time and will post revised terms at https://www.truist.com/terms-and-conditions/open-banking. Continued use of the service after the effective date of the revised Agreement constitutes your agreement to the changes.
USING THE SERVICE
By using the Service, you are expressly authorizing Truist to continuously share your Data with Company as permitted by law. The term “Data” means any of your account information (whether individually or jointly owned), which, depending on your consent terms and services with Company, could include but may not be limited to account ownership, name, date of birth, address, e-mail address, phone number, type of phone, income information, account balances, transactional history, tax data, payments due and owing, financial benefits, or any other information generally available. The exact Data shared with Company may be further described in the terms and privacy policies you have agreed to for use of its services. Once you have authorized us to share your Data with Company, we will continue to provide it until you instruct us to stop, as specified below in this Agreement. We reserve the right to decline to share your Data if permitted by law.
To enroll in the Service, you must (1) validate your identity, (2) read and agree to this Agreement, and (3) confirm which accounts you want us to share with Company. Not all accounts or all Data may be eligible for the Service.
TERMINATING THE SERVICE
You may revoke your authorization to share your Data with Company and stop using the Service at any time by notifying us by calling Customer Support at 888-228-6654 or by visiting https://bank.truist.com/web/profilese_ngs/connectedapps. You will need to disclose the name of the Company and the accounts you wish to terminate access to. Terminating your service with Company, is not always equal to terminating Truist’s sharing of Data with the Company. You agree to notify us promptly if you terminate your service with Company.
DATA SHARING, TRANSMISSION, AND USE BY COMPANY
Truist will use commercially reasonable efforts to timely provide your Data to Company. Data will be electronically transmitted across wireless and computer networks and, as such, delays or failure may occur (for example, due to system maintenance or network unavailability).
Once the Data is received by Company, Company may use this Data for its own purposes, in accordance with the terms you have agreed to for use of their services and is not governed or controlled by Truist. Please read and understand Company’s terms and privacy policy.
TRUIST DOES NOT ENDORSE AND IS NOT RESPONSIBLE FOR PRODUCTS OR SERVICES PROVIDED OR OFFERED TO YOU BY COMPANY. You agree and understand that Company is solely responsible for its services and maintaining the privacy and security of the Data in their possession.
LIMITATION OF LIABILITY
NEITHER TRUIST NOR ANY AFFILIATE WILL BE LIABLE TO YOU FOR ANY DIRECT DAMAGES OR LOSSES SUFFERED OR INCURRED BY YOU IN CONNECTION WITH THE SERVICE OR ANY FAILURE TO PROVIDE OR DELAY IN PROVIDING THE DATA. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
IN NO EVENT WILL TRUIST OR ANY AFFILIATE HAVE LIABILITY FOR ANY CONSEQUENTIAL, SPECIAL, PUNITIVE, OR INDIRECT DAMAGES OR LOSSES WHETHER ANY CLAIM FOR SUCH DAMAGES OR LOSSES IS BASED ON TORT OR CONTRACT OR WHETHER TRUIST OR ANY AFFILIATE KNEW OR SHOULD HAVE KNOWN THE LIKELIHOOD OF SUCH DAMAGES IN ANY CIRCUMSTANCE.
YOU AGREE THAT TRUIST WILL NOT BE LIABLE IN ANY WAY FOR SERVICES PROVIDED BY COMPANY, INCLUDING BUT NOT LIMITED TO ANY ACTIONS OR OMISSIONS BY COMPANY OR ANY COMPROMISE OR BREACH OF COMPANY’S COMPUTER NETWORKS OR SYSTEMS.
